Wall Pass Terms of Use

Welcome to Wall Pass! These Terms of Use ("Terms") govern your use of the Wall Pass mobile and desktop applications ("App") provided by Wall Pass, LLC ("we", "us", "our") and provide information about Wall Pass’s Services. By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

Use of the App

License: We grant you a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use in accordance with these Terms.

Restrictions: You agree not to:

• Use the App for any illegal or unauthorized purpose;
• Modify, adapt, or hack the App or attempt to gain unauthorized access to our systems or networks;
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the App without our express written permission.
  

User Content: You are solely responsible for any data, text, graphics, photos, profiles, links, or other content ("User Content") that you post, upload, publish, or display on or through the App. You retain ownership of your User Content.

Intellectual Property

The App and its original content, features, and functionality are owned by Wall Pass, LLC and are protected by copyright, trademark, and other intellectual property laws.

Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review the Privacy Policy to understand how we collect, use, and disclose information about you.

Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. 

Wall Pass, LLC cannot guarantee the App will be safe and secure, uninterrupted or error-free, that defects will be corrected, or that the App or the servers that make it available are free of viruses or other harmful components.

Limitation of Liability

In no event shall Wall Pass, LLC, its officers, directors, employees, or agents, be liable to you for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from:

• Errors, mistakes, or inaccuracies of content;
• Personal injury or property damage, of any nature whatsoever, resulting from your access to and use of the App;
• Any unauthorized access to or use of our secure servers and/or any and all personal information stored therein.

Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. Unless otherwise required by law, we will notify you (for example, through our App) before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to use the App, you will be bound by the updated Terms. If you do not want to agree to these or any updated Terms, you can delete your account.

These Terms shall be governed by and construed in accordance with the laws of the state of Ohio.
